MAYORAL PROCLAMATION IN RECOGNITION OF THE RETIREMENT OF THEODORE

Mayor DeBaecke and Deputy Mayor
Christopher Doyle honored Retired Chief Wells.
His wife was presented with an award also.
In addition, Sergeant Duff, on behalf of the FOP, presented the
Chiefs award. Retired Chief
Wells expressed his appreciation and noted it was his privilege to
serve.

NJ Dot Fiscal Year 2021 Municipal Aid Program –
Clerk Picariello reported North Hanover Township received an award, in
the amount of $162,000.00.

LGEF Grant Award – Clerk Picariello noted North
Hanover Township’s application, under the CARES Act, was approved.
ENGINEER’S REPORT Engineer Hirsh stated the FY2018 NJDOT project was complete and was being closed out this evening. He noted the FY2020 NJDOT project paving and striping work was completed. He stated driveway apron replacements were scheduled for today. Engineer Hirsh stated he received quotes for drainage improvements for Schoolhouse Road but felt it was a little high. He would solicit new quotes.

Resolution Authorizing Change Order #1 to Earle Asphalt Company
related to the Schoolhouse Road Improvements Project

RESOLUTION AUTHORIZING CHANGE ORDER #1 TO EARLE ASPHALT COMPANY RELATED
TO THE SCHOOLHOUSE ROAD
IMPROVEMENTS PROJECT
WHEREAS, by
Resolution 2019-74, the North Hanover
Township Committee awarded a Contract to Earle Asphalt Company for the
Schoolhouse Road Improvements Project in the amount of $166,813.13; and
WHEREAS, the
Township of North Hanover has funded the project through a FY2018
NJDOT Municipal Aid Grant in the amount of $235,000.00;
and
WHEREAS, the contract
required adjustment to reflect actual construction quantities; and
WHEREAS, current
Change Order #1 will bring the adjusted Contract price to $177,841.83
which is an increase to the original Contract price by 6.6% and is
permitted under the Local Public Contracts Law, and the Regulations
promulgated pursuant thereto, and the Township Committee deems it
appropriate to authorize this Change Order, subject to and contingent
upon compliance with the conditions set forth below,
NOW, THEREFORE, BE IT
RESOLVED by the Township Committee of the Township of North Hanover,
County of Burlington, State of New Jersey that Change Order #1,
submitted by Earle Asphalt Company and reviewed and authorized by the
Township Engineer, is approved in the amount of $11,028.70 to be added
to the contract, resulting in an adjusted contract amount of
$177,841.83; and
BE IT FURTHER RESOLVED
that nothing herein contained shall be deemed a waiver by the Township
of any claims it currently possesses, or may possess in the future,
regarding this Contract, the existing insurance policy, Performance and
Payment Bond, and any other rights, privileges or remedies otherwise
available to it.

A RESOLUTION AUTHORIZING PAY
ESTIMATE NO. TWO (2) FINAL TO EARLE ASPHALT COMPANY IN CONNECTION WITH
THE SCHOOLHOUSE ROAD IMPROVEMENT PROJECT (2018 NJDOT)
WHEREAS,
the Township of North Hanover’s Engineers, Environmental
Resolutions, Inc., has reviewed the Earle Asphalt Company Payment
Certificate No. 2, representing the final payment in the total amount of
$34,871.17, for the Schoolhouse Road Improvement Project; and
WHEREAS, the Township's
Engineer has determined that the condition of the improvement is
satisfactory; and
WHEREAS, it is the
recommendation of the Township’s Engineer that the Township of North
Hanover authorize the release of final payment on voucher in the total
amount of $34,871.17 to Earle Asphalt Company, Inc.; and
WHEREAS, it is the intention
of the Township Committee to approve the release of final payment on
voucher in the amount referenced herein, in accordance with the Township
Engineer’s recommendations.
NOW THEREFORE, BE IT RESOLVED,
by the Township Committee of the Township of North Hanover, that the
Township authorizes the final payment in the total amount of $34,871.17
to Earle Asphalt Company.
BE IT FURTHER RESOLVED that
copies of this resolution shall be provided to the Finance Director and
the Township Engineer for their information and attention.

Resolution Accepting Maintenance Bond for the NJDOT FY2018

A Resolution Accepting Maintenance Bond FOR the NJDOT FY 2018 SCHOOLHOUSE ROAD IMPROVEMENTS PROJECT PHASE I
WHEREAS, the project engineer, Joseph Hirsh, of Environmental Resolutions Inc. has inspected the improvements by Earle Asphalt Company. for the NJDOT FY 2018 Schoolhouse Road Improvements project phase I and recommended that the final payment be released due to the posting of the following:
Maintenance Bond number 82520844M by Federal Insurance Company in the amount of $26,676.27 for the NJDOT FY 2018 Schoolhouse Road Improvements project phase I to expire two years from the date of August 1, 2020.
NOW THEREFORE, BE IT RESOLVED that the Township Committee of the Township of North Hanover hereby authorizes the release of the final payment and performance bond to Federal Insurance Company for the NJDOT FY 2018 Schoolhouse Road Improvements project due to the posting and acceptance of the bonds cited above.

Resolution Authorizing Consent to New Jersey Department of
Environmental Protection Permit for Burlington Preservation Associates,
LLC

RESOLUTION AUTHORIZING CONSENT TO NEW JERSEY DEPARTMENT OF
ENVIRONMENTAL PROTECTION PERMIT FOR BURLINGTON PRESERVATION ASSOCIATES, LLC
WHEREAS, Millstream Apartments, located at 202 Croshaw Road in the Township of North Hanover has made application to the New Jersey Department of Environmental Protection (“NJDEP”) for a Treatment Works Approval Permit concerning Block 603, Lot 10 and 29; and
WHEREAS, the Township Engineer has reviewed said application made by the owner Burlington Preservation Associates, LLC and has recommended execution of the same.
NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of North Hanover, County of Burlington County, State of New Jersey that the Township Committee hereby consents to the proposed project and hereby authorizes the Township Engineer to execute the NJDEP Statements of Consent on behalf of the Township.
DISCUSSION

AOC Virtual Platform – Clerk Picariello reviewed
upgrades to recording/video equipment recently completed.
She also informed the Committee of the AOC request for ZOOM
installation. Mayor
DeBaecke noted we just invested in a sophisticated system that has the
same capability and feels this is an unfunded mandate. He noted in an
emergent situation the AOC has the capability to address.
After deliberation, there was a general consensus to have
Attorney Roselli address with the Judge.

Attorney Roselli stated final judgement was
received in the affordable housing.
He noted we were good until 2025.
TOWNSHIP COMMITTEE “COMMENTS” Committeeman Forsyth noted he reached out to JCPL with regards to the drainage issue on Meany Road caused by their property. He is awaiting their response.
Mayor DeBaecke noted the drive-thru tree lighting tomorrow evening at 7pm.

AUTHORIZING A CLOSED SESSION
MEETING
WHEREAS, the Open Public Meetings Act, P.L. 1975, Chapter 231 and P.L. 2001, C. 404, permits the exclusion of the public from a meeting in certain circumstances; and
WHEREAS, the Township Committee of North Hanover Township wishes to go into a closed Executive Session and is of the opinion that such circumstances presently exist which should not be discussed in public, and
WHEREAS. the Open Public Meetings Act pursuant to N.J.S.A. 47:1A-1 and N.J.S.A. 10:4-12 permits the Township Committee to discuss certain matter(s) in private, and in this case for the purpose of the Township Committee to discuss contract negotiations, litigation and personnel matters in this regard.
NOW, THEREFORE, BE IT RESOLVED by Township Committee of North Hanover Township that it will go into an Executive Session for the purpose of the Township Committee to discuss Administration Personnel Matter, Upper Freehold Contract Matter, Police Contract Matter, Contract Matters, Litigation and Personnel matters.
BE IT FURTHER RESOLVED that the results of such discussion may be revealed at such time as the matter(s) are resolved and/or a contract(s) is signed and/or the negotiations are formally settled. Interested parties may contact the Township Clerk anytime during normal business hours for periodic updates as to the availability in this regard.
